These Terms govern your use of the SMB Mastery coaching platform (the “Service”) provided by Pangolin Enterprises Pty Ltd (“SMB Mastery”, “we”, “us”). By accessing or using the Service, you agree to these Terms.

1. The Service

SMB Mastery is a private, invitation-based platform for delivering business coaching — managing sessions, journeys, transcripts, AI-assisted summaries, commitments, operator scorecards and related notifications.

2. Accounts and roles

Accounts are provisioned by the coaching practice. The Service defines three roles — coach, executive assistant (EA) and client — each with different permissions. You may use the Service only with an account issued to you and only for its intended purpose.

3. Account security

You are responsible for keeping your login credentials confidential and for activity under your account. Tell us promptly if you believe your account has been compromised.

4. Acceptable use

You agree not to: access or attempt to access data belonging to other clients; probe, scan or bypass the Service’s security or access controls; upload unlawful, infringing or malicious content; overload or disrupt the Service; or use it other than as intended.

5. Content you submit

You are responsible for the content you upload (including session transcripts and documents) and confirm you have the right to provide it. You retain ownership of your content; you grant us the limited rights needed to store and process it to operate the Service.

6. AI-generated content and its limits

The Service uses AI to draft summaries, themes and suggested commitments from transcripts. AI output may contain errors or omissions, is reviewed and approved by a human before it reaches a client, and is not professional, financial, legal or other regulated advice. You should exercise your own judgement.

7. Intellectual property

The Service, its software and design are owned by us or our licensors. Your data and coaching content remain yours.

8. Third-party services

The Service relies on third-party providers (hosting, database, AI and email). Their availability and terms are outside our control; the providers we use are listed in our Privacy Policy.

9. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and may perform maintenance or updates.

10. Suspension and termination

We may suspend or terminate access that breaches these Terms or that we reasonably believe poses a security or legal risk. On termination, data handling follows our Privacy Policy.

11. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that applies to you under law and cannot lawfully be excluded.

12. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or business, arising from your use of the Service. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the Service or paying the cost of having it re-supplied.

13. Governing law

These Terms are governed by the laws of South Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.

14. Changes to these Terms

We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.
